Pro nemovitosti nabyt\u00e9 p\u0159ed rokem 2021 plat\u00ed star\u00fd \u010dasov\u00fd test 5 let. V roce 2026 se tato pravidla nem\u011bn\u00ed.<\/p>\n<p>P\u0159i emigraci p\u0159ich\u00e1z\u00ed z\u00e1sadn\u00ed rozhodnut\u00ed: prodat p\u0159ed zm\u011bnou rezidence, prodat po zm\u011bn\u011b rezidence, nebo si nemovitost ponechat a pronaj\u00edmat. Nezapome\u0148te na povinnost ozn\u00e1mit F\u00da osvobozen\u00fd p\u0159\u00edjem nad 5 000 000 K\u010d podle \u00a7 38v z\u00e1kona \u010d. 586\/1992 Sb. &#8211; lh\u016fta je do term\u00ednu da\u0148ov\u00e9ho p\u0159izn\u00e1n\u00ed. Pou\u017eit\u00ed mus\u00edte F\u00da ozn\u00e1mit do term\u00ednu pro pod\u00e1n\u00ed p\u0159izn\u00e1n\u00ed za rok prodeje a dolo\u017eit do dvou let od prodeje.<\/p>\n<h2>Prodej po zm\u011bn\u011b rezidence: nerezident s 15% dan\u00ed<\/h2>\n<p>Po ztr\u00e1t\u011b da\u0148ov\u00e9 rezidence v \u010cR jste pro \u00fa\u010dely prodeje \u010desk\u00e9 nemovitosti nerezidentem podle \u00a7 17 z\u00e1kona o dan\u00edch z p\u0159\u00edjm\u016f. P\u0159\u00edjmy z prodeje nemovitosti um\u00edst\u011bn\u00e9 v \u010cR v\u017edy z\u016fst\u00e1vaj\u00ed \u010desk\u00fdm zdrojov\u00fdm p\u0159\u00edjmem dle SZDZ (zpravidla \u010dl. 13 vzorov\u00e9 smlouvy OECD), i kdy\u017e jste rezidentem nap\u0159. v N\u011bmecku nebo USA.<\/p>\n<p>Pro nerezidenty plat\u00ed stejn\u00fd \u010dasov\u00fd test (2 roky bydlen\u00ed \/ 10 let vlastnictv\u00ed), ale n\u00e1rok na osvobozen\u00ed pro &#8221;pou\u017eit\u00ed pro vlastn\u00ed bytovou pot\u0159ebu&#8221; je sporn\u00fd a v praxi obt\u00ed\u017en\u011b uznateln\u00fd, pokud bytovou pot\u0159ebu \u0159e\u0161\u00edte v zahrani\u010d\u00ed. Da\u0148 je 15 % z rozd\u00edlu prodejn\u00ed a nab\u00fdvac\u00ed ceny po ode\u010dtu prok\u00e1zan\u00fdch investic. Doporu\u010dujeme znaleck\u00fd posudek nab\u00fdvac\u00ed ceny, pokud nemovitost vlastn\u00edte v\u00edce ne\u017e 10 let nebo p\u016fvodn\u00ed kupn\u00ed smlouva neexistuje.<\/p>\n<h3>Praktick\u00fd p\u0159\u00edklad<\/h3>\n<p>Pan Nov\u00e1k koupil v roce 2018 byt v Praze za 4 000 000 K\u010d. V roce 2024 emigruje do V\u00eddn\u011b, byt prod\u00e1v\u00e1 v roce 2026 za 7 500 000 K\u010d. Investice dolo\u017een\u00e9 fakturami: 350 000 K\u010d. Nab\u00fdvac\u00ed cena 4 000 000 + 350 000 = 4 350 000 K\u010d. Zisk 3 150 000 K\u010d. \u010casov\u00fd test 5 let spln\u011bn (n\u00e1kup 2018, podle star\u00e9ho re\u017eimu) \u2192 p\u0159\u00edjem osvobozen, da\u0148 0 K\u010d. Pokud by pan Nov\u00e1k nemovitost koupil v lednu 2021 a prodal v roce 2026, \u010dasov\u00fd test 10 let by nebyl spln\u011bn \u2192 da\u0148 15 % \u00d7 3 150 000 = 472 500 K\u010d.<\/p>\n<h2>Da\u0148 z nabyt\u00ed nemovit\u00fdch v\u011bc\u00ed: kdo ji plat\u00ed v roce 2026<\/h2>\n<p>Da\u0148 z nabyt\u00ed nemovit\u00fdch v\u011bc\u00ed (4 % z kupn\u00ed ceny) byla zru\u0161ena z\u00e1konem \u010d. 386\/2020 Sb. s \u00fa\u010dinnost\u00ed od 26. z\u00e1\u0159\u00ed 2020. P\u0159i prodeji v roce 2026 ji ji\u017e \u017e\u00e1dn\u00e1 strana neplat\u00ed, co\u017e zjednodu\u0161uje vy\u00fa\u010dtov\u00e1n\u00ed a d\u011bl\u00e1 \u010cR atraktivn\u011bj\u0161\u00edm trhem. Sazby se v roce 2026 pohybuj\u00ed kolem 1-3,50 K\u010d\/m\u00b2 u staveb a 0,30-5 K\u010d\/m\u00b2 u pozemk\u016f s m\u00edstn\u00edmi koeficienty 1-5. Pro byt 75 m\u00b2 v Praze 6 to znamen\u00e1 cca 1 200-3 500 K\u010d ro\u010dn\u011b.
